Terms of Use

These Terms of Use (“Terms”) govern your use of NutriScan (the “App”). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App. The App is also subject to Apple’s standard Licensed Application End User License Agreement (EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If these Terms and the EULA conflict, the EULA prevails to the extent of the conflict.

NutriScan turns photos of your meals into stickers on a personal board. An AI model estimates the foods, portions, calories and macros (protein, carbohydrates and fat) and the App gives each meal an A–E grade inspired by Nutri-Score. You can also scan barcodes of packaged products, set a daily calorie target, view weekly insights and create challenges from your stickers.

• Wellness, not medicine. NutriScan is a general wellness app. It is not a medical device and does not diagnose, treat, cure or prevent any disease or condition. Nothing in the App is medical, nutritional or dietetic advice.
• Talk to a professional. Consult a doctor or a registered dietitian before changing your diet or setting a weight goal — especially if you are pregnant or breastfeeding, have diabetes or another medical condition, take medication, or are under 18.
• Eating disorders. NutriScan is not designed for people who have, or have had, an eating disorder, and it is not a treatment for one. If tracking food is affecting your health or wellbeing, stop using the App and seek professional help.
• Emergencies. NutriScan is not for emergencies. If you think you may have a medical emergency, call your local emergency number.

• Estimates can be wrong. Food recognition, portions, calories, macros and grades are approximate estimates made from a photo or from database values. Review and correct portions before relying on them.
• Product data. Barcode results come from Open Food Facts, a collaborative database, and nutrition values may come from USDA FoodData Central. Both may be incomplete or out of date.
• Daily target. The daily calorie target is a general estimate from the details you enter. It is not a prescription.
• Your responsibility. You are responsible for how you use the App’s output and for the decisions you make about your diet and health.

You must be at least 13 years old to use NutriScan. If you are under 18, or under the age of majority where you live, use NutriScan only with the permission and involvement of a parent or guardian.

You agree not to use the App to:

• Break any law, or upload photos that you do not have the right to share or that contain other people’s private information.
• Disrupt, reverse-engineer, circumvent the limits of, or abuse the App or its AI services.
• Create content that is illegal, harmful, hateful, or that violates the rights of others.

• Free to start. NutriScan is free to download. The free tier includes a daily allowance of meal scans together with your sticker board, grades and daily target.
• NutriScan Premium. Premium removes the daily scan limit. It is an auto-renewable subscription. The available periods and the price for your country are shown in the App before you buy.
• Billing. Payment is charged to your Apple ID account at confirmation of purchase or, if you start a free trial, when the trial ends.
• Auto-renewal. Your subscription renews automatically for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• Free trial. If a free trial is offered, it converts to a paid subscription at the end of the trial unless cancelled at least 24 hours before it ends. Any unused part of a free trial is forfeited when you buy a subscription.
• Manage or cancel. You can manage or cancel your subscription at any time in Settings → your name (Apple ID) → Subscriptions on your iPhone, or in your App Store account settings. Cancellation takes effect at the end of the current billing period. Deleting the App does not cancel a subscription.
• Price changes. If the price of your subscription changes, Apple will notify you in advance as required, and where required ask for your consent.
• Refunds. Refunds are handled by Apple under its policies: https://reportaproblem.apple.com.
• Restore. On another device signed in to the same Apple ID, use Restore in the App.

Your stickers, meals, profile, plan and challenges are stored on your device and you keep ownership of them. You allow us and our providers to process the photos and summaries you send only to produce your results, as described in the Privacy Policy at makwin.ai/nutriscan/privacy. Because there is no account, your data is not backed up by us; if you delete the App or lose your device, it may be lost.

The App, its design, its content and its software are owned by us or our licensors and protected by intellectual-property laws. You may use them for your personal, non-commercial use. Your stickers are made from your own photos and are yours.

The App is provided “as is” and “as available”, without warranties of any kind, including any warranty that estimates are accurate or that the App will meet your health goals. To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages, or for any reliance on AI-generated estimates, arising from your use of the App. Nothing in these Terms limits rights you have under consumer-protection laws that cannot be waived.

We may update these Terms from time to time. We will change the effective date above when we do. Your continued use of the App after changes take effect means you accept the updated Terms.
