Terms of Use

These Terms of Use (“Terms”) govern your use of Tempo: Healthy Eating Habits (“Tempo” or the “App”). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App. The App is also subject to Apple’s standard Licensed Application End User License Agreement (EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If these Terms and the EULA conflict, the EULA prevails to the extent of the conflict.

Tempo is a calorie tracker and eating-habit coach. You log meals by typing, dictating, taking a photo or scanning a barcode; an AI assistant estimates calories and macros and checks meals against the eating-habit rules you choose to practise. Tempo also tracks water, weight, your eating window and your progress on the rules.

• Wellness, not medicine. Tempo is a general wellness app. It is not a medical device and does not diagnose, treat, cure or prevent any disease or condition. Nothing in the App is medical, nutritional or dietetic advice.
• Talk to a professional. Consult a doctor or a registered dietitian before changing your diet, fasting, or setting a weight goal — especially if you are pregnant or breastfeeding, have diabetes or another medical condition, take medication, or are under 18.
• Eating disorders. Tempo is not designed for people who have, or have had, an eating disorder, and it is not a treatment for one. If counting calories or restricting food is affecting your health or wellbeing, stop using the App and seek professional help.
• Listen to your body. Calorie targets, eating windows and the rule ladder are general guidance. Stop and seek medical advice if you feel unwell.
• Emergencies. Tempo is not for emergencies. If you think you may have a medical emergency, call your local emergency number.

• Estimates can be wrong. Calories, macros, portions and food recognition from text, photos and barcodes are estimates. A photo estimate is shown as a range for that reason. Review and correct meal cards before relying on them.
• Product data. Barcode results come from Open Food Facts, a collaborative database, and may be incomplete or out of date.
• Your responsibility. You are responsible for how you use the App’s output and for the decisions you make about your diet and health.

You must be at least 13 years old to use Tempo. If you are under 18, or under the age of majority where you live, use Tempo only with the permission and involvement of a parent or guardian.

You agree not to use the App to:

• Break any law, or upload photos or content that you do not have the right to share or that contain other people’s private information.
• Disrupt, reverse-engineer, circumvent the limits of, or abuse the App or its AI services.
• Create content that is illegal, harmful, hateful, or that violates the rights of others.

• Free to use. Tempo is free to download. The free tier includes 3 AI logs a day (a chat message, a photo estimate or a fridge idea request each count as one). Manual logging, water, weight and the habit rules stay free.
• Tempo Premium. Premium removes the daily AI limit. It is an auto-renewable subscription offered yearly (US$29.99 per year, with a 7-day free trial for eligible new subscribers) and monthly (US$9.99 per month). Prices in other countries are set by Apple’s regional pricing and may differ; the price for your country is shown in the App before you buy.
• Billing. Payment is charged to your Apple ID account at confirmation of purchase or, for a free trial, when the trial ends.
• Auto-renewal. Your subscription renews automatically for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• Free trial. The yearly plan’s free trial converts to a paid subscription at the end of the trial unless cancelled at least 24 hours before it ends. Any unused part of a free trial is forfeited when you buy a subscription.
• Manage or cancel. You can manage or cancel your subscription at any time in Settings → your name (Apple ID) → Subscriptions on your iPhone, or in your App Store account settings. Cancellation takes effect at the end of the current billing period. Deleting the App does not cancel a subscription.
• Price changes. If the price of your subscription changes, Apple will notify you in advance as required, and where required ask for your consent.
• Refunds. Refunds are handled by Apple under its policies: https://reportaproblem.apple.com.
• Restore. On another device signed in to the same Apple ID, use Restore Purchases in the App.

Your diary is stored on your device and you keep ownership of what you log. You allow us and our AI provider to process the messages and photos you send to the coach only to produce your results, as described in the Privacy Policy at makwin.ai/tempo/privacy. Because there is no account, your diary is not backed up by us; if you delete the App or lose your device, your diary may be lost.

The App, its design, its content (including the habit rules and their texts) and its software are owned by us or our licensors and protected by intellectual-property laws. You may use them for your personal, non-commercial use.

The App is provided “as is” and “as available”, without warranties of any kind, including any warranty that estimates are accurate or that the App will meet your health goals. To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages, or for any reliance on AI-generated estimates or advice-like content, arising from your use of the App. Nothing in these Terms limits rights you have under consumer-protection laws that cannot be waived.

We may update these Terms from time to time. We will change the effective date above when we do. Your continued use of the App after changes take effect means you accept the updated Terms.
